  • Eric M Abramson was recently honored to be asked to lecture on the subject of third party liability for work place injuries at the 2008 Peace Officers Research Association of California Annual Convention in Monterey (PORAC). The presentation occurred on November 22, 2008 and covered topics including a comparison of the worker's compensation benefits system to the civil justice damages system, damages available in the civil justice system, identifying and pursuing third party situations including products liability, vehicular negligence, premises liability, medical malpractice and dependent adult abuse/neglect, and credit rights and reimbursement obligations. Eric also discussed how the civil justice system has benefited society by causing manufacturers to produce safer products; how the contingency fee arrangement discourages weak or so-called frivolous lawsuits, and provides everyone with a key to the court house and equalizes the playing field between individuals and multi-national corporations; that the widely repeated myths about the civil justice system are not supported by fact; and, the absolute necessity that an injured worker have experienced and expert legal representation in order to maximize the receipt of benefits and compensation from the worker's compensation and civil justice systems.
