Our work in products liability has led to the development of new laws to protect consumers. In 1984, attorney William B. Smith tried Lunghi v. Clark Equipment Co., 153 Cal.App.3d 485 (1984). It established that, per the Consumer Product Safety Commission, a product manufacturer who becomes aware of a product's dangers after it's on the market has a duty to warn of the danger short of product recall. Lunghi is the leading case supporting the duty to recall and retrofit. The law also encouraged Vioxx and Bextra manufacturers to recall unsafe pharmaceutical products.
