Our client v. an Olema delicatessen
Our client was touring the coast north of San Francisco with her husband and friends. They stopped for lunch at an Olema deli, purchased sandwiches and went outside on the deck to eat. The deli provided an eating area immediately adjacent to the parking lot where vehicles pulled in to park. The deli had two large benches available for eating. They faced the parking spots and were not separated with any barriers whatsoever. Our client was eating her lunch with her husband when a Danish tourist pulled into the parking spot in front of her, lost control of his car and pinned her against the wall as she sat on the bench. The impact crushed her leg and she required major surgery. The case settled for a confidential sum.
