Medical negligence involves a healthcare professional failing to provide proper care and harming a patient. Not every medical mistake counts as negligence. To meet the legal standard, four key elements must be present.

Below are the key elements of medical negligence

A duty of care existed 

A healthcare provider has a legal duty to care for their patients. This duty exists once a doctor agrees to diagnose or treat someone. It means the provider must follow accepted medical standards during the course of treatment.

That duty was breached 

Once a duty of care is established, it must be shown that the provider failed to meet that duty. This can involve errors in diagnosis, treatment, follow-up or communication. The standard used is what a competent professional would have done in a similar situation.

The breach caused harm

The patient must show that the provider’s actions or omissions directly caused injury or worsened the condition. This link between the breach and the harm is called causation. If the harm would have happened anyway, there may be no legal case.

There were measurable damages

To support a claim, the harm must lead to actual losses. These may include medical costs, physical pain, mental distress or lost income. Without measurable damages, a claim is unlikely to succeed, even if a breach occurred.

Each element must be proven for a medical negligence case to move forward. The process often involves opinions from other doctors, medical records and detailed analysis.
