Who can be held responsible for an Airbnb injury?
California premises liability law generally requires people who own, lease, occupy, or control property to use reasonable care to discover unsafe conditions and repair them or provide adequate warnings.
Depending on the facts, potentially responsible parties may include the property owner, the host, a property management company, or a contractor whose work created a dangerous condition. Responsibility can be shared. The person listed as the host may not own the property. A management company may handle inspections and maintenance. A separate owner or association may control the staircase or common area where the injury occurred. Sorting out these relationships matters. For example, if a guest falls when a rotten deck board gives way, an investigation may examine how long the deterioration existed, who inspected the deck, whether anyone reported the problem, and who had authority to make repairs.
Does Airbnb insurance cover guest injuries?
Airbnb currently describes its Host liability insurance, part of AirCover for hosts, as providing $1 million in coverage for certain claims when a host is legally responsible for a guest’s injury. Coverage is subject to policy terms, conditions, and exclusions. That does not mean every injured guest receives $1 million or that every accident is covered. Liability, the extent of the injury, and the applicable policy must still be evaluated. The owner or management company may also have other insurance. An attorney can investigate available policies rather than relying solely on the host’s statement about coverage.
A refund for your stay is also different from compensation for a personal injury. Medical bills, lost income, and lasting physical limitations may require a separate claim.
What should you do after an Airbnb injury?
Your health comes first. Seek appropriate medical care and tell your medical providers how the injury happened. If you can safely do so, take these steps:
- Photograph the hazard and the surrounding area. Capture the broken step, loose railing, water accumulation, or other condition, along with wider views showing its location. Do not put yourself at risk to collect evidence.
- Save the listing and reservation records. Keep screenshots of photographs, the property description, safety information, house rules, and booking confirmation.
- Preserve messages. Save communications with the host, property manager, Airbnb, and any insurer.
- Identify witnesses. Obtain contact information for anyone who saw the accident or noticed the condition.
- Report the incident in writing. Describe what happened accurately and keep a copy of the report.
- Keep records of your losses. Save medical bills, receipts, and information about missed work. Document how the injury affects your daily activities.
- Get legal advice before signing a release. A proposed payment or refund may come with language affecting your injury claim.
Evidence can disappear quickly when a property is repaired, cleaned, or rented to the next guest. Early legal involvement can help preserve inspection records, maintenance documents, prior complaints, and other relevant evidence.
What compensation may be available?
Depending on the evidence and applicable law, an injured guest may seek compensation for medical treatment, future care, lost earnings, reduced earning capacity, pain, physical limitations, emotional distress, and loss of enjoyment of life. A serious injury claim should account for what lies ahead. Someone who needs surgery may also need rehabilitation, additional procedures, or help at home. A brain injury may affect concentration, work, and family life even after the initial hospital stay. When an accident causes death, eligible surviving family members may have a wrongful death claim.
What if the host says the accident was my fault?
A host or insurer may argue that you should have seen the hazard, used a different route, or been more careful. That argument does not, by itself, resolve the claim.
An investigation can examine lighting, visibility, warnings, the property’s layout, and whether guests were expected to use the area where the injury occurred. Under California’s comparative fault rules, a person’s share of fault can reduce compensation without necessarily eliminating the claim.
How long do I have to bring a claim?
California personal injury lawsuits generally must be filed within two years of the injury, although exceptions and different deadlines can apply.
Reporting an accident to Airbnb or negotiating with an insurer does not, by itself, extend the lawsuit deadline. Prompt advice is especially important when the property is outside California or another jurisdiction’s law may apply.
