Family receives $32.5 million for boy’s brain injuries

Details of a recent medical malpractice claim 

A family in another state filed a medical malpractice lawsuit against a hospital after a young boy suffered a severe brain injury during birth. According to the lawsuit, medical providers failed to properly identify fetal distress as the mother went into labor. The lawsuit claimed the problems could have been successfully treated with antibiotics and a Cesarean section, but no treatment was given. 

Allegedly, the baby was born with hypoxic-ischemic encephalopathy, which is a type of brain damage caused by a lack of oxygen to the brain. After the baby was born, the lawsuit alleged that hospital staff also failed to give proper treatments that could have reduced the baby’s brain damage. The mother said her son now suffers from seizures, and cognitive impairment and requires around-the-clock care. Reportedly, the lawsuit was settled with the hospital agreeing to pay the family $32.5 million.
